FM Contract Pitfalls: Behind the SLA Numbers

When auditing facilities management contracts, published response times rarely tell the whole story. Estate managers must watch for these common contractual loopholes.

The "Attendance" vs. "First-Time Fix" Illusion

Many commercial FM contracts advertise aggressive 2-hour or 4-hour response SLAs. However, standard contract wording defines "Response" solely as engineer arrival to assess and make safe. Without adequate first-fix vehicle stocking or CAFM-led parts triage, critical plant often remains out of service for days waiting for specialist quotations.

Procurement Action:Negotiate dual SLAs: measure both "Attendance / Make-Safe" and "First-Visit Resolution Rate".
02 / Caution

Clock-Stopping Loopholes

Helpdesks frequently pause the SLA timer under contractual provisions such as "Awaiting Client Authorisation", "Parts On Order", or "Access Permitted Window Closed". A job logged at 09:00 with a 4-hour SLA may effectively take 72 hours while remaining technically marked as "100% SLA Compliant" in monthly board reports.

Procurement Action:Demand raw end-to-end downtime reporting alongside contractual SLA compliance metrics.
03 / Caution

Toothless Service Credit Caps

Where service credits exist for SLA breaches, they are commonly capped at 5% to 10% of monthly maintenance fees. In severe disruption cases (such as chillers failing in summer), the cost of the contractor dispatching an emergency specialist out-of-hours exceeds the small contractual credit deduction, disincentivising urgency.

Procurement Action:Combine service credits with explicit step-in rights allowing you to dispatch third-party specialists at the contractor’s expense.
